This Space Rental Agreement (“Agreement”) is made and entered into as of the date of signing by and between Hiya Pal!, located at 340 Pompton Ave, Cedar Grove, NJ (“Owner”), and the undersigned party (“Renter”).
1. USE OF SPACE
Renter shall have access only to the areas of the premises as previously agreed upon with the Owner. Use of any additional areas without prior approval is strictly prohibited.
2. KEYS & ACCESS
Renters will be provided with a lockbox code to access the space keys for the duration of the rental. Keys must be returned to the lockbox immediately following the rental. Any misplaced or unreturned keys will result in a $25 replacement fee.
3. PAYMENT TERMS
Rental fees must be paid in full and in advance for the entire duration of the class or event schedule. Failure to submit full payment prior to the commencement of the rental period may result in cancellation of this Agreement without refund.
4. RENTAL CANCELLATION
All rental cancellations must be made at least five (5) days prior to the scheduled rental date.
• For during open hours rentals, cancellations made fewer than five (5) days prior to the rental date will result in forfeiture of the full rental fee.
• For after-hours rentals, cancellations made fewer than five (5) days prior to the rental date will result in a $50 cancellation fee.
5. DAMAGE RESPONSIBILITY
Renter is responsible for any damage incurred to the space, equipment, or property during the rental period. Renter agrees to repair or replace any damaged items at their own expense. If repairs are not completed in a timely manner, Owner reserves the right to arrange necessary repairs and bill the Renter accordingly.
6. CLEANING & CLOSING PROTOCOLS
Renter agrees to adhere to all cleaning and closing procedures as outlined by the Owner. Failure to follow these procedures will result in a $25 cleaning fee per incident. Repeated failure to comply may result in termination of rental privileges without refund.
7. WAIVER REQUIREMENT
All participants in the class or event must sign the Owner’s liability waiver prior to participation. If the QR code is unavailable, the Owner will provide paper copies for signature.
8. PERSONAL INJURY & LIABILITY
Owner shall not be held liable for any personal injury, illness, loss, or damage to persons or personal property arising out of or related to the Renter’s use of the premises, services provided, or activities conducted during the rental period. Renter assumes full responsibility for the supervision, conduct, and safety of all participants, guests, and any minors associated with their event.
9. INDEMNIFICATION
Renter agrees to indemnify and hold harmless the Owner, its owners, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of or related to the Renter’s use of the premises or activities conducted during the rental period.
10. TERMINATION
Owner reserves the right to terminate this Agreement immediately for failure to comply with any of the terms set forth herein.
11. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions or understandings. Any modifications must be made in writing and signed by both parties.
